When renting in Japan, a personal guarantor, a rent-guarantee company and an emergency contact are different roles. A personal guarantor may become financially liable under a written guarantee agreement; a guarantor company provides a paid guarantee service and can seek repayment from the tenant after paying a covered amount to the landlord; an emergency contact is mainly for communication and does not become a guarantor merely by being listed as a contact. The exact combination required is decided by the property, landlord, management company and screening process, so confirm the rental contract and guarantee agreement before applying or paying any fee.

Know the three roles before you apply

Rental applications in Japan can ask for a personal guarantor, a rent-guarantee company, an emergency contact, or more than one of them. The names may appear together on the same application, but the responsibilities are not interchangeable.

The tenant remains responsible for normal obligations under the lease. Using a guarantor company does not turn unpaid rent into free assistance.

A personal guarantor can have real financial liability

For an individual revolving guarantee, Japan's Civil Code requires a maximum amount to be set; without a maximum amount, that individual revolving guarantee is not effective. Rental guarantees commonly involve continuing obligations, so the guarantee document should be checked for the stated maximum and scope rather than relying on a verbal explanation.

The landlord or management company decides its acceptance criteria. A potential guarantor may be asked for identification, address, employment, income and contact information.

A guarantor company is a paid service, not tenant insurance

A rent-guarantee company enters into a separate guarantee arrangement and normally charges the tenant an initial, monthly, annual or other fee according to its product and the property agreement.

If the tenant fails to pay a covered amount, the company may pay the landlord under the guarantee. The company can then seek repayment from the tenant. The tenant's debt does not normally disappear because the guarantor company paid the landlord.

Many properties specify which guarantor company must be used. Do not pay an outside company before the real estate agency confirms that the property accepts it.

Compare the total cost over the expected lease period, not only the amount due on move-in day. Check whether renewal of the rental contract and renewal of the guarantee contract create separate charges.

Screening can involve both the landlord and the guarantor company

Approval by a real estate agency does not necessarily mean that the landlord, management company and guarantor company have all completed screening. The processes can overlap but remain separate.

Applicants may be asked for identity, residence status, current address, work or school information, income, Japanese contact details and emergency-contact information. The exact requirements vary, and screening criteria are not always disclosed.

The Ministry of Land, Infrastructure, Transport and Tourism publishes multilingual rental-housing guidance for foreign nationals, including sample documents and checklists for the application and contract process.

MLIT also publishes a list of registered rent-guarantee companies and a separate list of registered companies that report foreign-language support. Registration can be a useful information point, but MLIT states that its registration system is voluntary, so an unregistered company is not automatically prohibited from operating.

A newer certified rent-guarantee company system also exists for housing-security support. Whether a specific property lets you choose among companies is still a separate matter.

An emergency contact is not automatically a guarantor

An emergency contact is generally provided so the landlord, management company or guarantor company has someone to contact if the tenant cannot be reached or an urgent situation occurs.

Listing a person as an emergency contact does not by itself create the same financial responsibility as signing a guarantee agreement. If the person has signed another document, however, read that document separately rather than assuming the role from the label.
